This Privacy Policy describes how Partners Coffee NYC Inc. its subsidiaries, successors and assigns (“we,” “us,” or “our”) collects, uses, and discloses your Personal Information when you visit or make a purchase from www.partnerscoffee.com, use the Partners Coffee mobile app (including for mobile ordering, in-store pickup, and café delivery), or visit any of our café locations. By using our website, app, or visiting our cafés, you agree to the collection and use of information as described in this policy.

 

1. Collecting Personal Information

We collect Personal Information through your use of our website, the Partners Coffee app, your in-store visits and purchases at our café locations, and when you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual as “Personal Information”.

  • Device and website information
    • Examples collected: browser version, IP address, time zone, cookie information, pages or products viewed, search terms, and how you interact with the Site.
    • Purpose: to load the Site accurately and to perform analytics on Site usage to optimize our Site.
    • Source: collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
    • Disclosed to: Shopify (our website platform). See Shopify’s Privacy Policy for details.
  • Accessibility information (AccessiBe)
    • Examples collected: browsing behavior, interaction patterns, accessibility profile preferences
      (such as font size, contrast settings, and screen reader usage), and device information.
    • Purpose: to optimize the accessibility and ADA/WCAG compliance of our website for users with
      disabilities, and to remember your accessibility preferences between visits.
    • Source: collected automatically through AccessiBe’s widget when you visit our website.
    • Disclosed to: AccessiBe (our ADA compliance platform). AccessiBe processes this data to deliver accessibility features and may use aggregated, anonymized data to improve its platform. See AccessiBe’s Privacy Policy for full details.
  • Cookie consent management (CookieYes)
    • Examples collected: your cookie consent preferences, the date and time consent was given or withdrawn, your IP address, browser type, and the URL on which consent was recorded.
    • Purpose: to record and manage your cookie consent in compliance with applicable privacy laws including CCPA/CPRA and GDPR, and to provide evidence of consent if required.
    • Source: collected automatically when you interact with our cookie consent banner on the website.
    • Disclosed to: CookieYes Limited (our consent management platform). CookieYes stores your consent records on our behalf. See CookieYes’s Privacy Policy for full details.
  • App information
    • Examples collected: name, email address, phone number, device type, operating system, app usage data, order history, pickup and delivery preferences, location data (where permitted), push notification preferences, and one-time passwords for account authentication.
    • Purpose: to provide mobile ordering, in-store pickup, and café delivery services, authenticate your account, manage loyalty program enrollment, send order confirmations and status updates, and
      improve app performance.
    • Source: collected automatically through your use of the app and directly from you when creating an account or placing orders.
    • Disclosed to: Per Diem Subscriptions, Inc. (Tryperdiem) (our mobile app platform, support@tryperdiem.com) and Square Inc. (operated by Block, Inc.), which processes orders and payments placed through the app. See Tryperdiem’s Privacy Policy and Square’s Privacy Notice for full details.
  • App SMS communications (Tryperdiem)
    • The Partners Coffee app is powered by Per Diem Subscriptions, Inc. (Tryperdiem), which sends SMS messages on our behalf through the app. By providing your mobile phone number during app sign-up or
      account creation, you consent to receive transactional text messages from Tryperdiem related to your Partners Coffee account.
    • Transactional messages are sent in response to actions you initiate and include:
      • One-time passwords (OTP) for account authentication and phone number verification
      • Loyalty program enrollment codes and confirmations
      • Gift card send and redemption notifications
      • Order confirmations and status updates including pickup ready notifications
      • Other transactional account-related notifications
    • With your explicit consent at the point of opt-in, Tryperdiem may also send you promotional SMS on our behalf including loyalty rewards, points updates, member offers, promotions, and café events. You will only receive promotional messages if you have opted in. You can opt out at any time by replying STOP, or by updating your preferences in the app settings. Opting out of promotional messages does not affect transactional messages.
    • Message frequency varies based on your activity and opt-in status. Message and data rates may apply.

  • Website SMS marketing (Attentive)
    • Our website SMS marketing program is operated by Attentive Mobile, Inc., which sends promotional text messages on our behalf to customers who have explicitly opted in through our website.
    • With your explicit opt-in consent, Attentive may send you:
      • Promotional offers, discounts, and new product announcements
      • Seasonal campaigns and limited edition releases
      • Cart abandonment reminders
      • Loyalty and rewards updates
    • You will only receive these messages if you have opted in via the website. You can opt out at any time by replying STOP to any message. Message frequency varies. Message and data rates may apply. For help,
      reply HELP.
    • Attentive collects and processes your phone number, opt-in consent, and messaging engagement data.
      Your data may be used by Attentive to deliver and optimize our campaigns.

  • Website email marketing (Klaviyo)
    • We use Klaviyo, Inc. to manage our website email marketing communications. When you subscribe to our email list or make a purchase on the website, your email address and related information are stored and processed by Klaviyo on our behalf.
    • Klaviyo may send you:
      • Order confirmations and shipping notifications
      • Promotional emails, new product announcements, and offers (with your consent)
      • Loyalty program updates and rewards communications
      • Abandoned cart reminders and personalized product recommendations
    • You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at hello@partnerscoffee.com. Unsubscribing from marketing emails does not affect transactional order emails.
    • Klaviyo uses cookies and tracking pixels in emails to measure open rates, click rates, and campaign effectiveness. This data is used to improve the relevance of our communications to you. See Klaviyo’s Privacy Policy for full details.
  • Order and account information
    • Examples collected: name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.
    • Purpose: to fulfill our contract with you — processing payments, arranging shipping, sending invoices and order confirmations, communicating with you, screening for potential fraud, and where you have indicated a preference, sending information about our products or services.

  • Customer support information
    • Purpose: to provide customer support.
    • Source: collected directly from you.

  • In-store and café information
    • Examples collected: in-store purchase details, transaction amount, payment card data (processed by Square), loyalty program activity, purchase history, and food or beverage preferences where
      provided to staff.
    • Purpose: to process your in-store order, manage loyalty or store credit accounts, issue receipts, send marketing communications via Square, and improve our café experience.
    • Source: collected directly from you at the point of purchase or interaction with our staff.
    • Disclosed to: Square Inc. (our in-store point-of-sale, loyalty, and marketing platform, operated by Block, Inc.). See Square’s Privacy Notice for full details. 
  • Square — point of sale, loyalty, and marketing
    • Our café locations use Square (operated by Block, Inc., 1955 Broadway, Suite 600, Oakland, CA 94612) as our point-of-sale system, and we also use Square for customer loyalty programs and marketing communications. Square’s involvement in processing your data is more significant than a typical payment
      processor and we want to be transparent about it.
    • What Square collects when you visit our cafés:
      • Transaction details including date, time, location, items purchased, and payment amount
      • Payment card information processed directly by Square to PCI-DSS standards — full card numbers are not stored
      • our name, email address, and phone number if you provide them to receive a digital receipt or join our loyalty program
      • Device and usage data from Square’s hardware and software systems
      • Purchase history and behavioral data used to build a profile of your preferences
      • How Square uses your data independently:
        • Square acts as both a service provider to Partners Coffee and, in certain circumstances, as an independent data controller in its own right. When Square sends you digital receipts, manages loyalty program communications, or contacts you via Square Marketing on our behalf, Square processes your data under its own privacy notice. This means:
          • Square may use your contact details for its own communications unless you opt out directly with Square
          • Square shares data with its affiliates within Block, Inc., which include Cash App and Afterpay
          • Square uses analytics partners including Google Analytics and Facebook for its own advertising purposes
          • Square retains your transaction and account data for the lifetime of the relevant account and beyond, as required by its legal obligations — we cannot delete Square’s copy of your data on your behalf
      • Your rights in relation to Square’s data:
        • If you wish to exercise your privacy rights in relation to data Square holds about you independently — including the right to know, delete, correct, or opt out of targeted advertising — you must contact Square directly. Partners Coffee cannot action these requests on Square’s behalf.
        • You can submit a privacy request to Square at privacy.block.xyz or by calling 1.844.213.7377. Select the Square logo and “Customer” when asked what type of data you are managing. You can opt out of Square’s targeted advertising via the “Your Privacy Choices” link on squareup.com or by enabling Global Privacy Control in your browser.
        • For Square’s full privacy practices please review Square’s Privacy Notice for Square Buyer Services, which applies when you receive digital receipts, participate in loyalty programs, or receive marketing via Square.
  • CCTV and surveillance
    • Examples collected: video footage of customers and visitors on our café premises.
    • Purpose: safety and security of customers and staff, incident investigation, insurance claims, and where required, law enforcement.
    • Source: closed-circuit television systems operating in our café locations. Notice of CCTV operation is posted at the entrance to each location.
    • Disclosed to: law enforcement or legal authorities where required by law, and our insurers in connection with claims. Footage is not shared with third-party advertising partners.
    • Retention: footage is retained for a limited period consistent with security and legal requirements and then deleted.
  • Minors
    • The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian of a child and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.


2. Sharing Personal Information

  • We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you. We do not sell your Personal Information to third-party vendors. We share information in the following circumstances: 
    • We use Shopify to power our online store. See Shopify’s Privacy Policy for how Shopify handles your data.
    • We use Klaviyo, Inc. to manage website email marketing. Klaviyo stores and processes your email address and engagement data to deliver and optimize our email campaigns. See Klaviyo’s Privacy Policy for details.
    • We use Attentive Mobile, Inc. to manage website SMS marketing for customers who have opted in. Attentive processes your phone number and messaging engagement data to deliver our SMS campaigns. See Attentive’s Privacy Policy for details.
    • We use Square Inc. (operated by Block, Inc.) as our in-store point-of-sale, loyalty, and marketing platform. Square acts as both our service provider and, in certain circumstances, as an independent data controller for your data. Square independently collects, retains, and uses transaction, loyalty, and marketing data in accordance with its own privacy notice. See Square’s Privacy Notice for details. Customers can manage their Square data rights at privacy.block.xyz.

    • We use Per Diem Subscriptions, Inc. (Tryperdiem) as our mobile app platform. Tryperdiem collects name, email, phone, device, and usage data through the app and sends transactional SMS on our behalf. The app connects to Square Inc. for café ordering and payment processing. See Tryperdiem’s Privacy Policy for full details.

    • We use Gorgias to manage customer support communications.

    • We use AccessiBe to provide ADA and WCAG accessibility compliance features on our website. AccessiBe may collect information about how you interact with our website in order to optimize the accessibility experience. See AccessiBe’s Privacy Policy for details.

    • We use CookieYes Limited as our consent management platform. CookieYes records and stores your cookie consent preferences on our behalf to demonstrate compliance with applicable privacy laws. See CookieYes’s Privacy Policy for details.
    • We may share your Personal Information to comply with applicable laws and regulations, respond to a subpoena, search warrant, or other lawful request for information, or to otherwise protect our rights.
    • We may share reviews left on our website with third-party vendors.
  • Third-party delivery platforms
    • Partners Coffee makes its menu available on third-party delivery platforms including Uber Eats, Grubhub, and DoorDash. Our relationship with these platforms is limited to menu and product information only.
      • We do not share any personal information with these platforms, including no personal data from Square, Shopify, Attentive, Klaviyo, or any other system.
      • We do not have access to any personal information collected by these platforms about their users, including order history, payment details, delivery addresses, or contact information.
      • If you place an order through Uber Eats, Grubhub, or DoorDash, your personal information is collected and processed by those platforms under their own privacy policies, not by Partners Coffee.
      • For questions about how these platforms handle your data, please contact them directly or review their privacy policies.

 

3. Behavioral Advertising

We use your Personal Information to provide you with targeted advertisements or marketing
communications we believe may be of interest to you.

  • Meta Pixel (Facebook / Instagram)
    • We use the Meta Pixel to measure the effectiveness of our advertising and to serve relevant ads on Meta’s platforms. As part of these campaigns, we or Meta may convert information about you, such as your email address or phone number, into a unique value that can be matched with a user account on these platforms to deliver advertising customized to your interests. You can manage your Meta ad preferences at facebook.com/adpreferences.
  • Google Ads
    • We use Google Ads for remarketing and conversion tracking. You can manage your Google ad settings at adssettings.google.com.

 

4. Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

 

5. Your Privacy Rights

  • California residents (CCPA / CPRA)
    • If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):
      • Right to know — you can request a copy of the Personal Information we have collected about you in the past 12 months, including the categories of data, sources, and third parties we share it with.
      • Right to delete — you can request that we delete your Personal Information, subject to certain legal exceptions.
      • Right to correct — you can request that we correct inaccurate Personal Information we hold about you.
      • Right to opt out of sharing — you can direct us not to share your Personal Information with third parties for cross-context behavioral advertising (see below).
      • Right to non-discrimination — we will not discriminate against you for exercising any of these rights.
  • Do Not Sell or Share My Personal Information: We do not sell your Personal Information for money.
    • However, sharing data with advertising platforms such as Meta and Google for targeted advertising may be considered “sharing” under California law. To opt out, email us at hello@partnerscoffee.com with the subject line “California Privacy Opt-Out” and we will process your request within 15 business days. You may also manage your preferences directly with Meta and Google using the links in Section 3.
    • To exercise your rights to know, delete, or correct, contact us at hello@partnerscoffee.com or by mail at the address in Section 14. We will verify your identity before processing your request and will respond within 45 days. If you would like to designate an authorized agent to submit requests on your behalf, please contact us at the address below.
    • If you are not satisfied with our response, you may contact the California Privacy Protection Agency at cppa.ca.gov.

 

  • Sensitive personal information
    • In the course of operating our business, we may collect certain categories of information that are considered "sensitive" under California and other applicable state privacy laws. This includes account login credentials, payment card information, and precise geolocation data. We do not use or disclose sensitive personal information for any purposes other than those described in this policy and those permitted by applicable law. We do not use sensitive personal information to infer characteristics about you.
    • Several US states have enacted privacy laws that may grant you rights similar to those described above for California residents, including rights to access, delete, correct, and opt out of certain uses of your Personal Information. These states include, but may not be limited to, Virginia, Colorado, Connecticut, Texas, Montana, and Oregon.
    • If you are a resident of a state with applicable privacy laws and would like to exercise your rights, please contact us using the information in Section 14. We will review your request and respond in accordance with the law applicable to your state.
    • Partners Coffee is a US-based company and we ship internationally on an occasional basis. If you are visiting or purchasing from the European Economic Area (EEA), the following applies:
    • We process your Personal Information under one or more of the following lawful bases:
      • Your consent
      • The performance of the contract between you and the Site
      • Compliance with our legal obligations
      • To protect your vital interests
      • For our legitimate interests, which do not override your fundamental rights and freedoms
    • If you are an EEA resident, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. To exercise these rights, please contact us using the information in Section 14.
    • Your Personal Information will be initially processed in Ireland (via Shopify) and may then be transferred outside of Europe for storage and further processing, including to Canada and the United States.     • If you are not satisfied with our response to a complaint, you have the right to lodge a complaint with your local data protection authority.

 

6. Automated Decision-Making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect on you.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. This includes:

  • Temporary denylisting of IP addresses associated with repeated failed transactions (persists for a small number of hours).
  • Temporary denylisting of credit cards associated with denylisted IP addresses (persists for a small number of days).

 

7. Retention

When you place an order through the Site, we will retain your Personal Information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. Order and account information is generally retained for seven years for tax and legal compliance purposes. You may request erasure of your Personal Information at any time by
contacting us — see Section 14.

 

8. Cookies

A cookie is a small amount of information downloaded to your computer or device when you visit our Site.

We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). They also provide information on how people use the website.

You can control and manage cookies through your browser settings, often found under “Tools” or “Preferences.” Please note that removing or blocking cookies may negatively impact your experience and some parts of the website may no longer be fully accessible. Additionally, blocking cookies may not completely prevent how we share information with third parties. To opt out of certain uses, please follow the instructions in Section 3 (Behavioral Advertising).

The length of time a cookie remains on your device depends on whether it is a session cookie (lasts until you stop browsing) or a persistent cookie (lasts until it expires or is deleted). Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded.

 

9. Do Not Track and Global Privacy Control

Because there is no consistent industry standard for responding to “Do Not Track” browser signals, we do not alter our data collection and usage practices when we detect such a signal.

We are working toward recognizing Global Privacy Control (GPC) signals as an additional way for you to opt out of the sale and sharing of your personal information. GPC is a browser-based signal that communicates your privacy preferences automatically. Until GPC recognition is fully implemented, you can opt out of the use of third-party cookies for personalized advertising by following the instructions in Section 3 (Behavioral Advertising) above.

 

10. Marketing Communications

From time to time we may email or text you about new products, promotions, and news. You can opt out of marketing emails at any time by clicking the “unsubscribe” link at the bottom of any marketing email or by emailing us at hello@partnerscoffee.com. Note that we will still send you transactional messages (order confirmations, shipping updates) even if you opt out of marketing.

 

11. SMS Mobile Messaging Program

Partners Coffee offers a mobile messaging program (“Program”). By opting into the Program, you agree to the following terms. Our SMS platform is operated by ElectricSMS. Support: text HELP to the number you received messages from, or email wesley@electricsms.com.

  • Opt-in and opt-out
    • By opting in, you agree to receive autodialed or predetermined mobile messages at the phone number associated with your opt-in. Consent is not required to make any purchase from us. Message and data rates may apply.
    • To opt out, reply STOP or STOPALL to any message from us. You may receive one confirmation message. If you plan to stop using or transfer your mobile number, please opt out first.
  • Program details
    • The Program involves recurring mobile messages about products, promotions, and order updates.
    • You must have a wireless device capable of two-way messaging and a text messaging service subscription.
    • You must be at least 13 years of age to participate; users between 13 and 18 must have parental permission.
  • Disclaimer
    • The Program is offered on an “as-is” basis. We are not liable for delays or failures in receiving mobile messages. Delivery is subject to your wireless carrier’s network and is outside our control.
  • Dispute resolution
    • Any dispute arising from the SMS Program is subject to the dispute resolution process set out in our Terms of Service, which requires informal resolution and mediation before arbitration and governs all disputes with Partners Coffee. The Terms of Service dispute resolution provisions, applicable law, and New York jurisdiction clauses apply to this Program in full.

 

12. Right to Appeal

If we deny your privacy rights request in whole or in part, you may appeal our decision. To submit an appeal, email us at hello@partnerscoffee.com with the subject line “Privacy Rights Appeal” and include a description of the request we denied and the reason you believe we should reconsider. We will respond to your appeal within 45 days. If your appeal is denied, you may contact the relevant privacy or consumer protection authority in your jurisdiction. California residents may contact the California Privacy Protection Agency at cppa.ca.gov. Residents of other states may contact the US Federal Trade Commission at ftc.gov/complaint.

 

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for legal or regulatory reasons. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated by email or by a prominent notice on our website. Your continued use of the Site after any changes constitutes your acceptance of the updated policy.
